Did Ambedkar really write the Indian Constitution? - India's Best Kept Secret

Judicial Cults and Collegium Lobbies have always tweaked and distorted the honourable constitution and used its provisional lacunae to promote a social order that is devoid of any common merit based system. Moreover, while some senior drafting committee members have a cult religio-political following, the majority of the actual members of the drafting committee are not even remembered! 


FACTS about the Constitution that every Citizen must be aware of: 

Who was the greatest contributor to the Drafting Committee? 

Even according to Dr Ambedkar himself, it is Mr B.N Rau who is sidelined as the constitutional advisor, who was single handedly responsible for framing most of the constitution. No doubt that it was done under the chairmanship of Dr Bhimrao Ambedkar. Dr. Ambedkar appreciates the work of B.N. Rau in his speech:“The credit that is given to me does not really belong to me. It belongs partly to Sir B. N. Rau, the Constitutional Adviser to the Constituent Assembly who prepared a rough draft of the Constitution for the consideration of the Drafting Committee.

A part of the credit must go to the members of the Drafting Committee who, as I have said, have sat for 141 days and without whose ingenuity of devise new formulae and capacity to tolerate and to accommodate different points of view, the task of framing the Constitution could not have come to so successful a conclusion. Much greater, share of the credit must go to Mr. S. N. Mukherjee, the Chief Draftsman of the Constitution. His ability to put the most intricate proposals in the simplest and clearest legal form can rarely be equalled, nor his capacity for hard work.” 

Total Amount of money & time spent: The expenses of the the Constituent Assembly were as high as Rs.63,96,729/- as on 22 Nov, 1949 after approximately 3 years of non-stop work by the drafting committee. Perhaps one of the most impressive points about B.N Rau is the fact that he undertook the services as a honorary task and never charged for it. 

The largest constitution of the world is a collated adaptation of specific parts of several international constitutions : 
The constitution has had 100 major amendments in the previous 70 odd years. Almost 85% of the constitution of India is a replica of the Government of India Act 1935 . Following are the features borrowed from other constitutions around the world:-

● USA- Fundamental Rights,Federal structure,Judicial Review, Independent Judiciary

● UK- Rule of law, Single citizenship, Parliamentary form of govt, Procedure established by law

● IRELAND- Directive Principles of State Policy

● AUSTRALIA- Concurrent list, Preamble

● FRANCE-Liberty, Equality, Fraternity(as in Preamble)

● CANADA-Distribution of powers between centre and state

● RUSSIA -Fundamental Duties

● GERMANY- Emergency Provisions

● SOUTH AFRICA- Amendment of Constitution

● JAPAN-Due Process of Law.

The man who almost single handedly drafted the Indian Constitution -
Benegal Narsing Rau (1887 – 1953) prepared the draft Constitution consisting of 243 articles and the Drafting Committee worked over it to expand it to 315 Articles. After the 2473 amendments, the final form of the constitution emerged with 395 Articles.Not even that, the President of the Constituent Assembly, Dr. Rajendra Prasad himself admired B.N. Rau on the day of signing Constitution:

“Dr. Ambedkar mentioned the names of these Committees. Several of these had as their Chairman either Pandit Jawaharlal Nehru or Sardar Patel to whom thus goes the credit for the fundamentals of our Constitution. I have only to add that they all worked in a business-like manner and produced reports which were considered by the Assembly and their recommendations were adopted as the basis on which the draft of the Constitution had to be prepared. This was done by Mr. B.N. Rau, who brought to bear on his task a detailed knowledge of Constitutions of other countries and an extensive knowledge of the conditions of this country as well as his own administrative experience. The Assembly then appointed the Drafting Committee which worked on the original draft prepared by Mr. B. N. Rau and produced the Draft Constitution which was considered by the Assembly at great length at the second reading stage.”

Dr. Ambedkar even went on to explain that he did not deserve that much credit for the making of the Constitution, and even paid his gratefulness to the members for extending him the Chairmanship of the drafting Committee:

‘I came into the Constituent Assembly with no greater aspiration than to safeguard the interests of the Scheduled Castes. I had not the remotest idea that I would be called upon to undertake more responsible functions. I was therefore greatly surprised when the Assembly elected me to the Drafting Committee. I was more than surprised when the Drafting Committee elected me to be its Chairman. There were in the Drafting Committee men bigger, better and more competent than myself such as my friend Sir Alladi Krishnaswami Ayyar. I am grateful to the Constituent Assembly and the Drafting Committee for reposing in me so much trust and confidence and to have chosen me as their instrument and given me this opportunity of serving the country. ”
